Terms of Sale
1. Introduction
Please read these terms carefully before placing an order with us. By making a purchase from our website, you agree to these terms in full.
2. Interpretation
When we say “we,” “us,” or “our,” we mean The Foam Shop, a trading name of Livedale Foam & Sundries Ltd.
When we say “you” or “your,” we’re referring to you—the customer or potential customer.
3. How to Order
What you see on our website is an invitation to place an order—not a binding offer. A contract is only formed when we officially accept your order.
Here’s how the process works:

Add your items to the basket and go to checkout.

Enter your contact and delivery details.

Choose your delivery method, confirm your order, and agree to these terms.

Complete payment through our secure payment gateway.

We’ll send you a confirmation email once everything's gone through.
If we can’t fulfill your order, we’ll let you know via email. We also reserve the right to decline any order at our discretion.
Please note: We don’t store copies of the version of these terms you agreed to, so it’s a good idea to download or print them for your records. These terms are only available in English.

4. Our Products
We sell foam cut-to-size products and related accessories at www.thefoamshop.co.uk, all provided by Livedale Foam & Sundries Ltd.
5. Prices & Payment
Prices are listed on our site. While we aim for accuracy, mistakes can happen—we’ll confirm the correct price during checkout.
Delivery charges, if any, are clearly shown during the order process.
Payment is required at the time you place your order. If payment isn’t received, we may cancel the order.
All prices include VAT.

Prices may change, but your order total won’t—once it’s confirmed, that’s the price you pay.
6. What You’re Promising
When you place an order, you confirm that:

You’re legally allowed to enter into contracts.

Your order information is accurate.

You’re able to receive the delivery.

You live in the UK.
-
You’re 18 years or older.
7. Delivery
If you choose delivery, we’ll send your order to the address you provided (to the door only).
We do our best to deliver by the date shown in your confirmation, but we can't guarantee delivery times due to courier delays.
Please inspect your order as soon as it arrives. Let us know immediately if anything is damaged.
Next-day delivery is available in most cases (90%), but again, courier delays are out of our hands.
Delivery is within the UK only unless agreed otherwise. Check our delivery page for more details.
8. Tolerance Policy
Let your foam rest for 24 hours after unpacking before checking the sizing.
Please report any sizing issues within 48 hours of delivery.
Foam is flexible—dimensions may vary by +/- 5mm. Don’t keep it wrapped for long periods, as this can permanently compress it.
9. Risk & Ownership
Once your order is delivered, it’s your responsibility. You officially own the products once we’ve received full payment and they’ve been delivered.
10. Cooling-Off Period
You have the right to cancel your order within 7 working days of receiving it (with some exceptions—see our Cancellation Policy).
Let us know in writing, return the items unused and in original condition, and cover the return postage.
If you don’t return the items, we may charge you the cost.

11. Your Legal Rights
Nothing in these terms affects your statutory rights.
12. Refunds
If you cancel an order, we’ll refund you using your original payment method within 30 days of receiving valid notice.
Important: We can’t refund Stockinette, as it’s fragile and doesn't ship well unless fitted inside a cushion cover. Only order Stockinette if you're okay with this.
13. Our Liability
We don’t exclude liability for things like death, personal injury, fraud, or illegal actions.
Products are for personal use—we’re not responsible for any business-related losses.
14. Force Majeure
We’re not liable if something out of our control (like extreme weather, strikes, etc.) prevents us from fulfilling our side of the deal. Both parties should try to minimize the impact and keep the other informed.
15. General Stuff

Product photos are for illustration only—actual products might differ slightly.

Some items may be glued or joined due to material limitations.

Stockinette and Dacron might not be available for larger items.
-
Large cushions may arrive in multiple parts if they exceed foam block sizes.
-
For outdoor cushions, use covers with a minimum UV50+ rating to prevent fading.
Changes to these terms require written agreement.
If a clause isn’t valid, the rest still apply.
A waiver of any term isn’t ongoing.
You can’t transfer your rights—we can, but only in ways that don’t reduce your protections.
These terms are the full agreement between us.
They’re governed by English law, and disputes go to English courts.
16. Chargebacks
If you’re unhappy, please follow our complaints process before starting a chargeback.
If a chargeback is misused, we reserve the right to charge:

£60 for each misuse

£60 per communication instance (including defending the chargeback and any back-and-forth).
17. Manufacturing Tolerances
All orders are subject to our standard tolerances, recycled/joined foam policies, and Stockinette limitations.
